These Service Terms & Conditions apply to heating, ventilation, and air-conditioning (HVAC) services provided by Cowboys Air Conditioning & Heating ("Cowboys AC," "we," "us") in San Antonio, Texas and surrounding areas. By scheduling or accepting service, you ("Customer," "you") agree to these terms. [TACLB License #: ________].
1. Scope of Work
We will perform the diagnostic, repair, maintenance, or installation work described in your work order, estimate, or agreement. Work not listed is not included unless added by a written and approved change order. Verbal requests for additional work may be documented and billed accordingly.
2. Estimates & Pricing
Estimates are based on conditions known at the time of inspection. Because HVAC systems can have hidden conditions (for example, concealed leaks, code issues, or failed components discovered during work), actual costs may differ. We will notify you and obtain approval before performing work that exceeds an approved estimate. Estimates are valid for the period stated on the estimate.
3. Scheduling, Arrival & Access
We schedule arrival windows and will make reasonable efforts to arrive within them; emergencies and weather may cause delays. You agree to provide safe, clear, and timely access to the equipment and work areas, including pets secured and obstructions removed. If we cannot access the property or no one is available, a trip or re-visit fee may apply (see Cancellation & Refund Policy).
4. Permits, Codes & Inspections
Where required, we will obtain applicable permits and perform work to applicable codes and manufacturer specifications. Permit and inspection fees may be billed to you. You are responsible for disclosing known property conditions that affect the work.
5. Customer Responsibilities
- Provide accurate information about the system, prior service, and known issues.
- Maintain electrical service, drainage, and structural conditions adequate for the equipment.
- Perform routine upkeep such as filter changes between visits unless covered by a plan.
6. Right to Refuse or Stop Work
For safety or code reasons we may decline or stop work, for example where we identify unsafe wiring, gas leaks, structural problems, or hazardous materials. We will explain the condition and recommended next steps.
7. Equipment & Refrigerant
Refrigerant handling complies with EPA Section 608 requirements. Old equipment and refrigerant are recovered and disposed of in accordance with law unless you request otherwise in writing and it is lawful to do so.
8. Limitation of Liability
Our liability for any claim arising from our services is limited to the cost of the services performed, except for liability that cannot be limited under Texas law. We are not responsible for pre-existing conditions, code violations created by others, or damage resulting from deferred recommended repairs.
9. Warranty
Workmanship and equipment warranties are described in our Workmanship & Warranty Policy.
10. Governing Law
These terms are governed by the laws of the State of Texas. Venue for disputes is [Bexar County, Texas].
